Филиппинские власти пригрозили семи криптоплатформам уголовными делами и штрафом

Комиссия по ценным бумагам и биржам Филиппин (SEC) объявила, что работающие в стране децентрализованная торговая платформа dYdX, а также криптоплатформы Aevo, gTrade, Pacifica, Orderly, Deriv и Ostium не зарегистрированы в ведомстве и не имеют лицензии, то есть действуют незаконно.

Ведомство сообщило, что без лицензии криптоплатформы не имеют права привлекать средства местных трейдеров. Перечисленные площадки не зарегистрированы в качестве поставщиков услуг виртуальных активов, обязанных соблюдать требования к минимальному капиталу, внедрять меры кибербезопасности, раздельно хранить собственные и клиентские активы, соблюдать правила борьбы с отмыванием денег (AML) и регулярно предоставлять отчетность местным властям.

Любой, рекламирующий перечисленные платформы на Филиппинах, может быть привлечен к уголовной ответственности, предостерегла SEC. Согласно местным законам о ценных бумагах, операторам всех семи сервисов грозит штраф до 5 млн филиппинских песо ($89 000) или до 21 года тюрьмы.

Филиппинские власти ужесточили контроль за криптовалютным бизнесом — в декабре ради борьбы с нелицензированными провайдерами криптоуслуг местные интернет-провайдеры заблокировали американские биржи Coinbase и Gemini. В августе прошлого года SEC обвинила криптобиржи OKX, Bybit, KuCoin и Kraken в нелегальной деятельности, заявив, что это подвергает филиппинских инвесторов серьезным финансовым рискам.

В 2024 году ведомство потребовало от компаний Google и Apple удалить из магазинов приложение крупнейшей по объему торгов криптобиржи Binance, заявив, что торговая площадка предлагает незарегистрированные ценные бумаги и является незарегистрированным брокером.
