Власти США разрешат иностранным криптобиржам вернуться в страну
Отдел надзора за рынком Комиссии по торговле товарными фьючерсами (CFTC) опубликовал правила регистрации для иностранных криптобирж, которые планируют предоставлять свои услуги клиентам из США.
Регулятор отметил, что система регистрации в иностранной торговой палате (FBOT) распространяется на все рынки, как традиционные, так и цифровые, независимо от класса активов. Это значит, что криптовалютные биржи, такие как Binance, KuCoin, Bybit, OKX и HTX, ранее заблокированные из-за отсутствия регистрации, смогут вернуться на рынок США.
Для получения регистрации иностранная биржа должна продемонстрировать свое соответствие нескольким требованиям. Так, криптоплатформа должна быть авторизована, лицензирована или зарегистрирована в своей домашней юрисдикции как регулируемая биржа. При этом надзор со стороны местного регулятора должен быть всесторонним и сопоставимым с подходом CFTC.
Помимо этого, цифровая площадка будет обязана заключить соглашение об обмене информацией с CFTC, а также обеспечить проведение клиринговых расчетов по сделкам через зарегистрированные у регулятора клиринговые организации (DCO) которые станут контрагентом для участников сделок.
Ранее исполняющая обязанности председателя CFTC Кэролайн Фам (Caroline Pham) сообщила, что надзорное ведомство готово разрешить спотовую торговлю криптовалютами на зарегистрированных в США биржах деривативов.
