Регулятор предлагает использовать двойное подтверждение резервов. Ежемесячно генеральный и финансовый директоры лицензированного эмитента должны подтверждать достоверность отчета о составе резервов. Также требуется ежегодное подтверждение этих данных от зарегистрированной аудиторской компании — что эмитент стейблкоинов действительно соблюдает требования к резервам.
NYDFS считает нужным установить лимит на объем резервных активов, которые может хранить один кастодиан. Это должно снизить риск концентрации средств у одного кастодиального сервиса, который может стать банкротом или пострадать от технического сбоя. Компаниям, чей объем выпущенных стейблкоинов составляет более $25 млрд, предлагается хранить как минимум 0,5% резервов (но не более $500 млн) на депозитах в застрахованном депозитарном учреждении.
Предельный срок погашения стейблкоинов по запросу держателя — два рабочих дня. Вводить дополнительные ограничения на этот срок могут только Управление контролера денежного обращения США (OCC), Федеральная резервная система США (ФРС) или NYDFS, настаивает ведомство. Если объем резервов эмитента сокращается ниже установленного минимума и остается на этом уровне 15 рабочих дней подряд, эмитент обязан начать процедуру ликвидации и погасить находящиеся в обращении стейблкоины без взимания платы с клиентов.
